The mission of Lag Box dba Laggit Golf is to improve your golf game through fun games that augment your reality.  We want to deliver a quality experience that will help you to improve your golf scores on the course.  In pursuit of this mission, we collect and use certain information from our players’ information and respecting their privacy is extremely important to Lag Box. 

When utilizing Lag Box Games and Web Services, you will be subject to this Privacy Policy.  We highly recommend you read this Policy before using Lag Box Games and Web Services.  This Policy describes how we acquire, house, utilize, disseminate, and otherwise process your personal data when we provide our Games and Web Services.  This Policy does not provide for the rights and obligations that a contract would provide.

Introduction

Lag Box develops and publishes golf skills improvement games for web and mobile devices.  “Lag Box”, “we”, “our”, or “us” in this Privacy Policy refers to Lag Box, LLC and any other corporate entities under common ownership with Lag Box, LLC.

For purposes of data protection laws, Lag Box, LLC is the “data controller” of your personal information.  We will refer to countries in the European Union (EU) and the European Economic Area (EEA) , and Switzerland collectively as the “European Countries” in this Privacy Policy.

You are subject to this Privacy Policy when you engage our Games and Web Services.  It provides you the information that shows how we acquire, house, utilize, disseminate, and otherwise process your personal data.  The Privacy Policy sections are listed and hyperlinked in the Table of Contents above for easier navigation.

You may not opt out of any portion of this Privacy Policy and still use our Games and Web Services. 

1. Information We Collect and How We Collect It

You will provide us with information that we will accumulate and house when you create an Account or user profile.

Personal Data About Yourself that is Shared With Us

When you utilize our Games or Web Services, you will supply us with information and data when you set up your Account or Player Profile.  We will house and utilize that information in our business for the purposes detailed in this Privacy Policy. 

Our Games and Web Services will use conventional registration procedures or set-ups where we requrest information such as:

• Your complete name;

• A user-name  you create;

• Your biological sex;

• Your age or date of birth;

• Your preferred email;

• A password and/or;

• Any other information that helps us to identify you or enhances your game experience.

The profile you create may allow other players to view your profile.  It may include information like:

• A profile photo of yourself;

• Your name;

• The username you created;

• Your biological sex;

• Other personally identifiable information such as your age;

• The town or city you claim to live in upon registration;

• A link to your social media profiles;

• Information about your gameplay; and/or

• Information and IDs created by Lag Box that we use to identify you on our Websites or games.

Providing us with your telephone number will give us the ability to acquire and store that number (which includes using for SMS text messaging).

              Your Contact Information

We will ask for and acquire permission to acquire information about your contacts.  You have the responsibility to seek their permission before granting consent. 

You may have the option to import your contacts from your mobile device or enter them manually to have the ability to locate contacts who also utilize Lag  Box Games and Web Services and you may invite them to play a game or use other Web Services.  It is your responsibility to guarantee that your sharing and acquiring a contacts’ information complies with all applicable laws which may require advance permission before providing this data to us.  Other Lag Box users may share your contact information with us in the same manner.  We will house this information to assist you and your contacts to connect with each other through our Games and Web Services.  Follow the procedures and instructions in our Web Services to remove your contact information that we store.  We will not store any passwords that are required to access your contact information or address books.

Data Generated Throught the Use of Our Games and Web Services

We collect data about how you utilize and interact with our Games and Web Services.

Using our Games and Web Services allows up to acquire information about your uses and interactions with our Games and Web Services.  This data includes the time spent playing and interacting, utilizing game features, results of games with other players, and other gameplay events.

We will acquire data on your communications that are used through the Lag Box Games and Web Services if you make the choice to utilize these components of the Games and Web Services.  The data collected will include:

• Your posts in player forums and message boards;

• Your posts or comments on other players posts, or their profiles;

• Any non-public messages or invites to other players that are made directly through or Games or Web Services;

• Your chats with other players using our chat functions; and/or

• Content such as photos, drawings, or other content that you post.

Real-time access, recording, and/or storing of all types of content and communications on Lag Box’s servers will be standard procedures used to protect the safety and well-being of our players, and to protect Lag Box’s rights and intellectual property in connection with our Games and Web Services.  Additionally, we will conduct research to improve, personalize, and enhance our Games and Web Services for the player experience through utilizing analytics, and to provide pertinent advertising.  If required by law, we will get your consent for this.

Information on Payments

 

When you make purchases, we will collect information that relates to the purchase. 

The purchase of in-game items or virtual tokens will be process by our third-party payment processor who will collect financial information needed to complete the purchase and charge your account.  Information acquired may include your billing address, e-mail address, and other financial information.  Lag Box’s contracted payment processors do not share your financial information with Lag Box, but will share information that is non-financial in nature that is related to your purchases for us to be able to properly provide the Services or items purchased. 

When you make purchases through platforms or third-party applications while utilizing our Games or Web Services through those other platforms or applications, processing of your purchase will be with the third-parties, and you will be subject to those third-party’s terms of service and privacy policy.  Lag Box will not receive your financial information when purchased through third-party apps or platforms, but we will receive non-financial information in order to properly process your purchase or provide your service.  The Lag Box Terms of Service provides explanations on our policies and terms related to charges, billing, and other items. 

              Customer Support Correspondence

A record of all correspondence between you and Lag Box will be archived for retention purposes.

Our Customer Support team will collect and house the contact information you provide when you request our help.  This includes but is not limited to your name, e-mail address, game play information or activity on our Web Services, and your Lag Box user name or Player ID number.  We will also retain any communications when you engage with our Customer Service team and other information in those communications to provide our support and enhance our Games and Web Services.

Information from Connected Third-Party Applications and Social Networks that is Acquired

By accessing our Games and Web Services from other companies that include social networks, some information will be acquired by your use of those other companies and social networks.

Lag Box may acquire information about you when you connect to our Games and Web Services through third-party applications or social networks such as Facebook.  The type of data depends on factors like the game played, the third-party application used, the settings on your device, and potentially the privacy settings of friends on the third-party application.

For example, Lag Box may collect and store some or all of the following information from the provider of the connected third-party application:

• Your first and last name;

• Your profile picture or its URL;

• You user identification number (like your Facebook ID number), which may be linked to publicy-available data such as your name and profile picture;

• Public information about your friends’ user ID or other publicly available data;

• Any e-mail address provided by you to the third-party application;

• An approximate physical location including your device that you use to access our Games or Web Services;

• Your biological sex;

• Information about your date of birth or range of age;

• Data about events or posts on or through the third-party application; and or

• All other data that you or the third-party provider share with Lag Box. 

 

Accessing our Services from a third-party application or platform will subject you to the terms and conditions and privacy policies of that third-party.  We recommend you read the third-party applications’ terms of service and privacy policy.

Data will be collected about your device and your utilization of our Games and Web Services by employing cookies.  Please see our Cookie Notice to know how to opt-out of this data collection.

Cookies and similar technologies are used by us, our service providers, and other related third-parties to acquire and analyze particular types of technical data, which includes:

• Internet Protocol address;

• Data on the computer or mobile device type you utilize;

• The operating Platform;

• The version of your operating system;

• MAC Address, Apple Identifier for Advertising, and/or Android Advertising ID

• App performance and debugs;

• The type of browser;

• The amount of clicks on an app or web page;

• The time spent playing the Games or using the Web Services;

• Names of Domains;

• Landing pages;

• The order of pages viewed; and/or

• The state of the Game and dates and activities on our Web Services.

 

Your social network ID or Lag Box user ID may be connected with the above information in some instances. 

In addition to device identifiers, if you play on a mobile device, we will gather the following data:The name you have associated with your device;

• Your country;

• The mobile telephone number if provided by you;

• With your permission, a specific geographic location;

• The contacts in your mobile device provided we have your permission as detailed in Information About Your Contacts; and/or

• Data on your device about Lag Box games and other third-party applications.

Information from Other Sources

Informaiton may be gathered from other third-party sources.  We will inform your if we do gather this information.

Third-party information providers and other sources my divulge data about you.  This data along with data provided by you directly is used to help us connect you with friends or make our advertisement more appropriate for you and your interests.

1. How We Use Information We Collect and Our Legal Bases for Processing It

 

Your information is utilized to offer, individualize, sustain the protection of and enhance the Games and Web Services you use; to sustain our business operations, for communication with you; for protection of yourself and others; to perform marketing and advertising; and to exercise, protect, or confirm our rights.

There are several legal bases we rely on to utilize your information which includes the establishment and performance of our contract with you, for our lawful pursuits, compliance with legal obligations, to confirm, and secure Lag Box’s rights, or from your consent.

 

 

Your information we gather and house is primarily used to give you the requested Web Services and enhance your overall game experience.  We have additional uses for why we gather and house your information which include:

• Enhancement and improvement of our Web Services and game play;

• Making user accounts so that allows game play;

• Personalization of our Games and Web Services to provide suggestions on potential players you might want to play with;

• To talk about features, new offerings, in-game updates, and other items or topics we think may be of interest to you;

• To allow other players to communicate with each other;

• Providing technical support and responding to inquiries;

• Promote and secure the safety and welfare of our users;

• To protect the rights and property of Lag Box and our Games and Web Services;

• To stop fraudulent or illegal actions, and enforcement of our Terms of Service;

• To supervise and disseminate contextual and behavioral advertising;

• To conduct surveys, contests, or other promotional activities or events that we sponsor or manage from us or our affiliates;

• To be in compliance with all legal obligations, resolution of disagreements we may have with you or other players, and enforcement of agreements with third-parties; and/or

• Conducting activites to further research.

 

The legal basis of our gathering and utilizing of information for persons residing in European Countries or the UK as detailed in Section 1 depends on the specific data and the context in which it is gathered. 

Most of the time, however we will only gather information from you that is necessary for our contract performance with you, where we maintain legitimate interests (as long as your interests or rights do not override our legitimate interests), or we have secured consent from you.

We may have a legal obligation or need to gather data from you or may somehow need the personal data to preserve your important interests or those of another person (such as another player) in some circumstances. 

If we request for you to give us information so we can be in compliance with legal requirements or for contract performance with you, this should appear obvious based on the manner in which we are requesting your data such as creating a user name and player account, and, if need be, we will explain to you the reason at the proper time.  You will know whether it is mandatory to give us the information requested.

If we rely on our valid pursuits or those of any third-party to gather and utilize your data which we did not list above, we will clarify at the proper time what those valid pursuits are.

1. How We Share Information

When using our Games or Web Services under the conditions set forth in this section, we will share your information with third-parties.

To enable gaming interactions with your friends and other Lag Box players, we share some of your data with them. 

In the following circumstances, we may share your data, including personal data, with third-parties, or let third parties gather this data from our Games or Web Services.

Information, including personal data may be shared with third-parties or we may allow third-parties to collect this information from our Services in the following circumstances:

              Other Lag Box Players and Friends

Lag Box games and Web Services encourage interaction with other players.  Connecting to a social network such as Facebook will allow your friends who also play Lag Box Games to see your player profile, and other data about your gaming.

Also, many Lag Box games, other players, regardless of whether they are social network friends, can see your player profile and data about your gaming, communicate with you in our Games and Web Services, and send friend requests and game requests.

With the Lag Box Group of Affiliated Companies

Other companies in our Affiliated group will be able to access and use your personal data.

Your personal data may be shared with Lag Box affiliated companies to allow the group to execute the purposes set forth in this Privacy Policy.

Behavioral Advertising, Analytics, and Third-party Advertising

Your information will be shared with advertisers to tailor the ads you see when you utilize our Games and Web Services to your interests.  This also allows us to offer some of our Games and Web Services free of charge.

The use of advertising allows us to provide some of our games, features, and web services for no charge.  Advertisements comprise, but are not limited to, banner ads, full screen ads between moves or games, or other offers where third-party advertisers offer inducements or game prizes for watching advertisements or completing tasks, or visiting websites, or creating accounts on other games or websites, completing surveys, or reaching certain game levels.  Third-party advertisers make these offers, not Lag Box.

 

Some of our games, game features, and web services are offered for free because we use advertising.  The utilization of advertisements include, but are not limited to, badder ads on game boards or services, full screen ads between turns or shots, or via an “offer-wall” whereby third-party advertisers offer items of value to our players in exchange for various actions taken by you such as watching videas, completing tasks like creating accounts on other websites or games, completing surveys, or reaching a game level.  Third-pary offer wall providers supply the offer-wall advertisements and not Lag Box.

Unless you provide consent, we will not share personal data that can identify you with third-party advertisers for their direct marketing purposes. 

When utilizing our Games or Web Services, us or third-party advertisers may gather and share data to enable us or them to provide you with more relevant advertising.  The forms of data gathered and shared when utilizing our services include:

• Data on how well their ads perform such as how many clicks an ad received;

• Technical information such as advertising identifiers and IP addresses;

• Your social network or Lag Box player ID; and/or

• Other data regarding your game play that can provide context like game use and your skill level

Beside providing you appropriate ads, the data we collect may be used to:

• Calculate the effectiveness of ads;

• Utilize behavioral advertising to provide you advertising that is more targeted to your personal experience and thereby more likely to be something that is of interest to you; and/or

• Carry out analytics on traffic in our networks and games to enhance the game play experience. 

Cookies and similar technologies that track you may be utilized to gather this data by Advertisers, and it can be one or multiple technologies simultaneously.

Be aware that clicking on an advertisement from a third-party may navigate you away from games or sites that are controlled by Lag Box.

Safety, Security, and Compliance with Law

If necessary, we will share your data if the situation requires safety, security, or compliance with legal obligations or the law.

We will access and monitor the contents of all of your communications in our Games and Web Services and between you and Lag Box and we may disclose this data as needed:

• To comply with laws or regulations that are applicable;

• In response to a lawful request by government authorities such as for, national security, law enforcement, or legal processes such as subpoenas, search warrants, or court orders.;

• With other companies and organizations to prevent fraud, provide security, report criminal activity, prevent our Services being used in commissions of crimes if we believe in our sole discretion that this is taking place;

• An emergency situation arises where we have a good faith belief that it poses an imminent danger to the health and/or safety of your or another person, or the general public; and/or

• Preservation and protection of the right or property of Lag Box or any applicable third-parties, which includes enforcing the Terms of Service.

 

Third-Party Service Providers

Your data will be shared with the third-party service providers with whom we work to bring our Games and Web Services. 

We will share your data with third-parties who conduct services for us such as payment processing, analytics, hosting, customer service, advertising and marketing, and optimization of advertising.  Your data will also be shared with third-party contractors and partners who help us to provide and enhance our Games and Web Services, which includes platform partners (Facebook, Google, Apple, etc.).  We make sure to have the correct agreements with our partners in order to secure and protect your data to comply with all applicable data security laws. 

              Sale or Merger

If a potential sale or merger is contemplated, we may share data with the party of interest so that a proper evaluation may take place. 

If an event takes place where Lag Box undertakes a business transaction, like a merger, being acquired by another company, or a sale of assets, we may divulge or transfer all of your data, including personal data, to a successor company in the transaction.  If such a transaction occurs, we will endeavor to inform you.  This will be in the way described in the Changes to Our Privacy Policy section.

              Other Third Parties

If you provide consent, we may share some of your personal data with other third parties. 

Provided we have your consent, we may share your personal information with other third parties or allow them to gather your data from our Games or Web Services in ways that are not specifically detailed in this Privacy Policy.

1. Your Rights and How to Access, Update, and Manage Your Personal Information

Residents of the UK or European Countries have certain rights when it comes to your personal data.

              UK and European Countries’ Users’ Rights

Residents of the UK or European Countries (as defined above in Sectioin 1), have the listed  information security rights:

• By using our Personal Data Request Portal, you may request that your personal data be deleted.

• You have the options to correct or update your personal data, request that we restrict the processing of your personal data or request that your data be made portable. 

• You can follow the instructions below in “Opting out of Promotional Communications” if you want to opt-out of advertising communications from Lag Box.  Opting Out of Promotional Communicationis from Lag Box has instructions showing how to opt-out of marketing communications. 

• Withdrawal of consent to have your personal data gathered, housed, and processed can happen at any time.  This withdrawal of consent does not affect our lawful processing of our actions before you withdrew your consent, nor does it affect any actions we take for processing your data on lawful grounds other than consent.

• Complaints to local data protection authorities regarding our gathering and utilizing your personal data is your right.  Contact your local data protection authority for more information on your rights to file complaints.

• If you are located in the Republic of Turkey, you have the rights listed under Article 11 of the 6698 No. Law on Protection of Personal Data.  Contact Us for your queries and requests.

Accessing and Deleting Personal Information Held by Lag Box

Use our Personal Data Request Portal to request a copy of or deletion of your account data on the game. 

Reviewing and updating your personal data or player profile can be done on the settings page in the game or website. 

If you request deletion of your account data, we will take all reasonable mesures to accomplish deletion of your account data from our records.  If you have previously provided consent on the game or web service, we may be unable to delete your account information.  Furthermore, we will retain certain records (such as payment information or customer service issues) where we have the need and rights to, such as for compliance for legal obligations or accounting purposes.  We will also retain information to secure, defend, or establish our rights. 

Information Received From Third-Party Apps/Platforms and the Management Thereof

Use the tools and settings provided by third-party apps/platforms to manage the data that we receive from these apps and your mobile device.

You must follow the instructions provided by third-party applications or platforms (Facebook, Apple, Google, or Amazon) to control the information and change your privacy settings that Lag Box will receive about you from those applications and platforms.

You can review the access permissions that Lag Box for games and websites maintains on your mobile device by navigating to the “settings” page of your mobile device or web browser.

Lag Box will provide an option to limit the extent to which our games will have regarding gathering information from non-Lag Box applications that reside on your mobile phone.  The games setting page will have the option to limit this information. 

Upon receiving information from a third-party application/platform or from your mobile phone, Lag Box will house and utilize this data in accordance with this Privacy Policy.  See above to access and update this information. 

Promotional Communications from Lag Box and Opting Out

Promitional emails will provide you the options to “unsubscribe” through a link or by visiting the Email Settings page.  You may also opt out of push notifications on the settings page.  You can text STOP to opt out of SMS messaging. 

It will take a maximum of ten business days to process your unsubscribe requests or email preference changes.  You may receive additional promotional emails during the processing period.

Push notifications are messages the app sends to your mobile device regardless of the status of your device or app.  You can turn off push notifications in the settings page.

Contact us or text STOP to the number we used to send the text from to opt out of SMS messaging.

Be aware that you may still receive communications from us that are not promotional in nature.  If we need to provide vital information about the games or web services, we will reach out.  Other circumstances in which you will receive non-promotional communications from us is when we need more information from you about a specific transaction, or if we are required by applicable laws to provide any notice to you about updates to our Privacy Policy or our Terms of Service.

Third-Party Behavioral Advertising and Opting Out

Your device settings and other third-party tools will allow you to opt-out of third-party behavioral advertising. 

For more information about behavioral advertising and your options to prevent this form of advertising from third-parties, you can visit the following websites:

• The opt-out pages operated by the Network Advertising Initiative or the Digital Advertising Alliance if you are based in the U.S.; and

Your mobile device should allow you to adjust the ad tracking settings through “Limit Ad Tracking” if you do not want to receive in-application behavioral advertisements from third-parties that are relevant to your interests on your mobile device.  To prevent the continued use of existing behavioral data related to your previous “Advertising Identifier”, you may reset the Advertising Identifier (like the IDFA) from the settings on your mobile device.  You may also have the option to download apps from your platform provider that will assist you in controlling the gathering and utilization of cross-ap data for behavioral advertising, such as the Digital Advertising Alliance’s “AppChoices” app. 

The options described above are provided by third-parties, not by Lag Box.  Lag Box has no operational control over these apps or tools, and how the third-parties provide these apps or tools.

Be aware that after using these opt-out tools and apps, you may still receive third-party advertisements in Lag Box games and services, and these ads may be less relevant to your interests.

Lag Box has no responsibility for the methods that third-parties employ to gather and utilize your personal data, unless they are acting under our orders.

 Privacy Policies of Linked Third-Party Services and Advertisers

Third-party services may have links on our games and web services that navigate to websites, online services, or mobile apps that are not the property of Lag Box.  Lag Box takes no responsibility for the privacy practice or the content of these Third-Party Services.  You should review the policies and terms of these Third-Party Services if you have questions about how your personal data is gathered and utilized.

1. Our Policies Concerning Children

We try to make sure that we do not collect personal data from children.

Children under the age of 13 (or under 16 for children residing in the UK or European Countries) are not a target demographic for our games.  Without parental consent, we do not permit Children to use our games or web services. 

In signing up for our games or web services we may collect information on your age or date of birth.  Users who identify as Children will be provided a version of the service or game that does not collect, house, disseminate, or utilize personal data.  The Children’s Online Privacy Protection Act (“COPPA”) is the pertinent legislation that we seek to follow to protect the rights of Children. 

Reasonable measures will be employed to remove information from our records if we determine that we have gathered personal data that is not an exception to COPPA from a Child. 

1. International Operations and Transfers Out of the UK or European Countries

Your personal information may be transmitted to the United States and other countries when utilizing our games or web services.  Compliance with legal requirements for processing this personal information from people residing in the EEA is our ultimate goal, and we will implement adequate safeguards when transmitting to “approved” countries.

Personal information may be transferred for valid business purposes to “Affiliated Entities” from international operations which are other entities under common control with Lag Box, or they may be our business partners and other service providers.

Personal data about users  and visitors to our sites is stored on servers located in the United States, may also be processed in other countries where our Affiliated Entities, business partners, and service providers maintain operations.  Personal data gathered in the EEA may be transferred to, and housed at, at locale outside of the EEA for various purposes such as:  processing payment transaction details or providing support services.  We will take the steps necessary to securely and lawfully treat your personal data when we transfer it internationally in the following manner described here.  We may institute implementation of the European Commissions’ Standard Contract Clauses regarding transfers of personal data between our Affiliated Entities, business partners, and service providers, that protects your personal data processed in the EEA, or employ other solutions that are lawfully compliant.  Be aware that laws vary from place to place, and the privacy laws that apply in places where your information is transferred to or housed, utilized, or processed in, may differ from the applicable privacy laws where you reside. 

1. How Long We Keep Your Information

Your personal data will be kept for as long as necessary to offer our games and web services, sustain our valid business interests, and/or execute, secure, or prove our rights. 

The length of time we will retain your personal data depends on why it was gathered, and how we used it, but it will not be retained any longer than is necessary for our business purposes or legal obligations.

As long as you have an active user account, we will retain your personal data.  Reasonable measures will be taken to remove your personal data if you deactivate or delete your account.  If necessary to execute, secure or prove our rights, you acknowledge that some of your information will be retained after your account is deactivated or deleted.

1. Security of Your Information

We are diligent in protecting your data, but your cooperation is also necessary.

We take reasonable steps and the proper security measures to provide security for your information online and offline and is in compliance with this Privacy Policy.  The measure are commensurate with the level of sensitivity of your data.

Profile data is protected by the password you use to access your Lag Box account if you registered directly with Lag Box.  Maintenance and protections of your account’s security is of paramount importance.  You are responsible for notifying us immediately if there is unauthorized use of your account.  Lag Box’s services will allow you to reset your password if you request instructions on resetting your password.  Access to our services or games through a social network may lead to someone deleting or accessing your account without your permission if you are hacked.  Be cautious and keep your social network account information and passwords secure.  We recommend logging out of your Lag Box account following each use.

Payment information is encrypted when you transmit that information through our app and third-party payment processor.
